The Site is a Platform for owners of property or their agents ("Owners") to offer for rent, a specific holiday rental property to potential renters (each, a "Renter" and, collectively with an Owner, the "Users"). We do not own nor can we enter into any contract concerning any property listed on the Site. Furthermore we are not involved in any actual transaction between Renters and Owners even though we may from time to time provide tools, such as direct booking, that enable a Renter to enter into a transaction to rent a specific property directly from the Owner of that property.

A condition of your continued use of this Site is that you agree not to use this Site for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws and regulations. Your continued use of the Site also signifies that you indemnify Us from any loss or damage or costs in connection with any breach of these conditions or any other legal obligation by you and your use of, or conduct on the Site.

Although we do charge Owners to advertise their holiday rental properties on the Site, we do not charge Renters to access the Site and research listings. Accordingly, We grant Users a limited, revocable, non-exclusive license to access the Site to, as applicable, advertise holiday rental properties and/or research, view or make legitimate enquiries to Owners regarding their interest in particular holiday rental properties for their personal use, all in accordance with these Terms. Any other use of the Site including, but not limited to, data gathering, extraction, copying, collection, duplication or display is expressly prohibited.

This Site does provide limited purpose licences to General Search Engines that use tools to gather information specifically for the purpose of displaying links to the Site. The term General Search Engines does not include any search engine, website or other service that provides classified listings or property rental advertisements, or any similar business that provides holiday property rental services.

We have no duty to pre-screen content posted on the Site by Owners, Renters or other Users and we are not responsible for user contributed information. We do, however, reserve the right to decline to permit the posting on the Site of, or to remove from, any user-contributed information that fails to meet our content requirements.

We make no representation as to the accuracy of the information contained within the Site. The property details content is the sole responsibility of the Owner of the property displayed. We have not confirmed the accuracy thereof and accordingly holidaymakers are strongly recommended to make their own investigations into the authenticity of any information supplied. We are in no way liable for any inaccuracies or misleading statements made in the information provided by the Owner or agent of properties on the Site.

All property listings on the Site are submitted by the Owner and are the responsibility of the Owner, and We specifically disclaim any and all liability arising from the alleged accuracy of the listings, property reviews, guest book entries, or any alleged breaches of contract on a Owner's part. Owners are solely responsible for ensuring the accuracy of any property descriptions and for keeping their property detail information up to date on the Site, including, but not limited to any and all representations about any property, its amenities, location, and its availability for a specific date or range of dates.

We do not represent or warrant that any of the copy, content, property reviews, property location, suitability, pricing or availability information published on the Site is accurate or up-to-date even in the case where prospective Renters have searched for specific special offers, dates, or types of properties. We reserve the right at all times to disclose any information as permitted by prevailing law to satisfy any law, regulation or government request.

Unless otherwise detailed in these Terms and Conditions or otherwise applicable law requires Us to allow the User to do so, We do not permit the following actions without the prior written consent of Us

1. Reproduce, extract, upload, display or distribute any part of Site in any form whatsoever
2. Translate into any language or computer language or any part of this Site
3. Use the Site other than to advertise and/or research holiday rentals and to make legitimate enquiries to our Owners
4. Use the Site to make any false, fraudulent or speculative reservation, or any reservation in anticipation of demand
5. Display, upload or transmit any information that constitutes or contains false or misleading information of any nature
6. Display, upload or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law or for any other purpose that is unlawful or prohibited by these Terms
7. Display, upload or transmit to the Site or use any device, software or routine that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that may damage, interfere or attempt to interfere with, or intercept, the normal operation of the Site

If you see or experience any user-contributed information or other content, activity or communication through or in connection with the Site, that appears to infringe any requirement of these Terms and Conditions, we ask that you to inform us at support@rentINbansko.co.uk.

The Owner or their agent represents and warrants that they

1. Own the copyright of the photographs and text loaded onto the Site
2. Authorise and grant permission for a non exclusive, unrestricted, worldwide and royalty – free licence for Us to use the photographs, text and any other material loaded onto the Site for promotional purposes
3. Indemnify Us immediately on demand against any cost, loss or liability (including legal costs) which We may incur by reason of any breach of copyright arising from its use of the photographs, text or other material
4. Grant Us the ability to copyright and protect the photographs, text and any other material available via your listing from the unauthorized use by unaffiliated third parties and agree to assist Us, at our expense and control, to protect such copyrighted material from unauthorized redistribution

The photographs, text, files, images and other materials on the Site are only available for the purposes of personal use by the Users. All content on the Site, and the Site itself, is protected by the copyright of Us. Reproduction, extraction or use of any material other than for personal, non-commercial use by any User is expressly prohibited without prior written permission from Us or the applicable copyright holder.

We reserve the right to amend the design, layout and functionality of the Site at any time.

We reserve the right to review, edit, copy or amend the content, layout or photographs supplied by Owner at any time. Any submission may be subject to review at any time.

We do not accept and We shall not have any liability for any loss or damage resulting from the design or positioning of the text, property, content and / or photographs or any change made to any text, photograph or content submitted by any Owner and edited or amended by Us.

We may change, suspend or discontinue any aspect of the Site at any time, including the availability of any Site features, database, or content, where we have legal, commercial or technical reasons to do so. We may also impose limits on certain features or services or restrict your access to parts or all of the Site for similar reasons.

There may also be times when the Site becomes inaccessible as a result of technical difficulties experienced by Us or on the Internet. We will, however, use reasonable skill and care to overcome these difficulties where they are within our control. Please note, however, that we cannot guarantee continuous access to the Site or any of its specific features.

We do not warrant that the operation of the Site will be uninterrupted or error free. In no event shall We become liable to the Owner, Renter or any User for any consequential, incidental or indirect damages.

We reserve the right to amend these Terms and Conditions at any time. When any amendments are made, We will notify Users that amendments have been made, when the amendments will take effect and update this page.

If Owners do not wish to be governed by the amended Terms and Conditions, they must notify Us in writing on or before the changes take effect and either cease to use the Site or choose to remain bound by the previous Terms and Conditions for the remainder of the advertising period for which they have already paid.

Each advertised listing on the Site pertains to an individual and uniquely identifiable property that is available for short term rental. Only one property can be advertised per listing. Each listing cannot refer to multiple properties or be an example of the type of property that is available. We reserve the right to amend or remove any listing where more than one property is advertised and retain any fees already paid in respect of the property listing.

Each advertised listing on the Site pertains to an individual and uniquely identifiable property that is available for short term rental. If an Owner alters or amends any part of the advertisement in a way that changes the listing to make it that of another property then We reserve the right to amend or remove any listing and retain any fees already paid in respect of the property listing.

We reserve the right to remove from adverts both email addresses and links to external websites without notice which either do not conform to the guidelines provided, or which We feel are not appropriate, or act against the interests of the company or its advertisers. Should a User re-submit the email address or link with Our consent then We reserve the right to amend or remove any listing and retain any fees already paid in respect of the property listing.

The success of converting enquiries to actual rentals relies upon the availability of Owners to respond to enquiries either by telephone or email. We require all Owners to be available to respond to enquiries within 72 hours. Should Owners be unavailable for longer than 72 hours, we ask that they either provide an answerphone message or automated email response to this effect or to make alternative arrangements in order to potential Renters to have their enquiries answered.

Should all options above not be possible, we ask that Owners contact Us so We can temporarily suspend their listing. We ask that Owners contact us by e-mail to support@rentINbansko.co.uk in order to have their listing re-activated.

We reserve the right to suspend listings where we receive substantiated complaints from potential Renters that Owners are not responding to their enquiries in an acceptable period. We deem an acceptable period to be 72 hours and will investigate such complaints prior to suspension of any listing for this reason. We reserve the right to terminate any of the Owners listings and remove them from the Site should the Owner be found to be persistently not responding to enquiries.

We reserve the right to refuse any listing submitted to Us. We may refuse a submission for listing for any reason and are not required to advise the Owner of the reason. The prospective Owner agrees that We cannot be liable from any loss or liability that may arise from our refusal to accept a listing.

All listings accepted will be for the period requested and paid for by the Owner. If a listing is removed at the request of the Owner prior to the end of the period then it is not subject to any refund either in part or in full.

Any Owner that submits unsuitable material to the Site or into Our database, or persistently misuses the Site, or is in material breach of these Terms and Conditions, We reserve the right to immediately remove any of the Owners listings from the Site without refund.

If We receive substantiated complaints from Site Users concerning a specific listing that identify misrepresentation of any aspect of the property or its surroundings, We reserve the right to immediately remove any of the Owners listings from the Site without refund.

If We receive substantiated complaints from Site Users concerning infringement of the rights of a third party, We reserve the right to immediately remove any of the Owners listings from the Site without refund.

If We consider that any listing contains any offensive, libellous, fraudulent, mis-representative or untrue content in any way, We reserve the right to immediately remove any of the Owners listings from the Site without refund.

We reserve the right to amend the Prices and Advertising Conditions of the Site without notice. New Prices will be immediately be applicable to all Owners for all new listings, adverts and advertisers and to renewals for both new and existing Owners and Users.

Once a potential Owner registers and advertises their property on the Site then payment should be made at the same time on the same day. There are 3 methods of making payment for any listing or advertisement requested on rentIN Bansko.

1. If payment is being made by credit or debit card this can be processed online by our online card payment provider.
2. If payment is being made by cheque, these should be made payable to rentIN Abroad Ltd and should be sent on the day of inputting a property to rentIN Bansko at 8 The Old Town Hall, 142 Albion Street, Southwick, Brighton, BN42 4AX.
3. If payment is to be made by bank transfer then an e-mail should be sent to support@rentINbansko.co.uk on the day of inputting the property requesting Our bank account details to which a transfer should be made.

Any listing or advertisement will not be accepted until clear payment is received from the potential Owner. If a listing or advertisement is accepted and displayed on the Site and clear payment is not received then it will be immediately removed without refund or liability.

We provide an advertising service rather than a physical product. We offer a 'cooling off period' of seven working days wherein a customer may cancel the requested advertising by email to support@rentINbansko.co.uk (stating the Listing Identification Number and the password of the Owner). We will then refund the amount paid less an administration fee of £20.

Our services are defined for Value Added Tax (VAT) purposes under paragraph 3, Schedule 5, of the Value Added Tax Act 1994.

We are legally required to charge VAT on our fees at the prevailing rate (17.5% at the time of writing but subject to change) to Owners and Advertisers who are resident in the UK.

If you are resident of any country outside the European Union (EU), VAT will not be charged as our services are outside the scope of UK VAT when provided to you.

If you are a resident of any country within the EU, but outside the UK, no VAT is payable provided that you are advertising your property for a business purpose. In this context, a "business purpose" means that you rent property on a regular basis to generate income. If you opt not to pay VAT you may be required to account for VAT on our fees in your local jurisdiction.

You are normally considered a resident in the country where you pay tax.

Please note that all Owners are responsible for charging and accounting to the relevant authorities for taxes (including, where relevant, VAT) on the rental payments they receive.

These Terms and Conditions are intended to constitute the entire agreement between Us and all Owners, Renters and Users with respect to the use of the Site. We reserve the right to immediately terminate any User's access to or use of the Site due to such User's breach of these Terms or other unauthorized use of the Site.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of any such right or provision. If for any reason a court of competent jurisdiction finds any provision of these Terms, or portion thereof, to be unenforceable, that provision shall deemed severed, and the remainder of these Terms shall continue in full force and effect.
